By downloading, installing, or using the Fitness AI mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Fitness AI is a mobile health and fitness tracking application that provides:

• AI-powered food recognition from photos
• Calorie and macronutrient tracking
• Meal logging with barcode scanning and food search
• Weight tracking and progress visualization
• Streak tracking and habit formation tools
• Calorie and macro rollover between days
• Cloud backup of your data (optional)

You may use certain features of the App without creating an account. To access full functionality, you must register using an email address, Google Sign-In, or Apple Sign-In.

You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

Fitness AI offers free and premium subscription tiers. Premium subscriptions are managed through the Google Play Store or Apple App Store and are subject to their respective terms and refund policies.

• Subscriptions automatically renew unless cancelled before the renewal date
• You can manage or cancel your subscription through your device's app store settings
• Downgrading from premium to free removes access to premium features at the end of the billing period

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's infrastructure
• Circumvent rate limits, device attestation, or other security measures
• Create multiple accounts to abuse free-tier limits or promotional offers
• Use automated tools, bots, or scrapers to access the App
• Upload malicious content, including harmful images or code

Fitness AI is not a medical device and does not provide medical advice.

The nutritional information, calorie estimates, and macro breakdowns provided by the App are approximations generated by AI and third-party food databases. They should not be relied upon for medical, dietary, or clinical decisions.

Always consult a qualified healthcare professional or registered dietitian before making significant changes to your diet, especially if you have a medical condition, food allergies, or specific dietary requirements.

We make no warranties regarding the accuracy, completeness, or reliability of any nutritional data provided through the App.

The App, including its design, code, features, content, and branding, is the property of Fitness AI and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the practices described in the Privacy Policy.

We reserve the right to modify, suspend, or discontinue the App (or any feature) at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App.

We do not guarantee uninterrupted, error-free, or secure access to the App. Service may be affected by factors outside our control, including network issues, device compatibility, or third-party service availability.

To the fullest extent permitted by law, Fitness AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Inaccurate nutritional data or food recognition results
• Loss of data, including meal logs or backup data
• Unauthorized access to your account
• Service interruptions or downtime
• Any health outcomes related to use of the App

Our total liability for any claim arising from the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

We may suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. Upon termination:

• Your right to use the App ceases immediately
• Your local data remains on your device
• Your cloud backups and account data may be deleted after a reasonable period

You may delete your account at any time by contacting us. This will remove your account data from our servers.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.
